MOD's Admission Links Cancer to Toxic Fumes

The very welcome news that the Ministry of Defence (MOD) has recently admitted a link between the development of a pilot and navigator’s cancer and exposure to toxic fumes during the course of their service flying and navigating Puma and Chinook helicopters may open the way for many other service personnel and their families to not only reassess whether they may have grounds to review their military pension entitlement but also to consider bringing a claim for compensation against the MOD for failing to take all reasonable steps to protect the individual from exposure to hazardous fumes and risk of injury in the course of their service.

In the 2000s, I spent considerable time investigating and advising airline pilots who faced similar issues following exposure to toxic cabin air fumes in commercial airlines. The issues were complicated, technical and involved specialist medical opinion.

These cases are very similar although the legal principles of proving fault against the MOD and that the injuries caused by that fault are easy to explain, in reality these types of exposure cases involve considerable investigation and more importantly expert technical and medical evidence which can often hold the key to success or failure.

However, as I have often suspected following my involvement in these issues there are certainly grounds for investigation and I would be extremely keen to discuss these with any serving or ex-service personnel or their families who may have experienced symptoms or illness that they feel related to exposure to toxic materials and fumes during their military service not only as pilots or navigators but as ground engineers, support crew or simply passengers.

An injured person only has a certain amount of time within which to bring a claim, I am a highly experienced personal injury solicitor who takes on both private and no win no fee claims, so I would urge readers who feel that they may be affected by these issues to contact me without delay at Pardoes Solicitors on: 0800 862 0442, email enquiries@pardoes.co.uk or visit our website: www.pardoes.co.uk.
